Employers are required to protect their employees\u2019 health and safety in the workplace and must take steps to assess and prevent risks. Severe penalties may be faced by the companies that fail to do so.<\/p>\n<\/div>\r\n\n\n

April 28, 2019, is the World Day for Safety and Health at Work.<\/strong>\u00a0This year\u2019s celebration is special because it marks the centenary anniversary of the International Labour Organisation (ILO).
\nEmployers have a legal obligation to take all necessary steps to protect employees.<\/strong>\u00a0This applies not only to\u00a0employees\u2019 physical safety and health<\/strong>\u00a0(protection from workplace accidents and occupational diseases),\u00a0but also their mental health<\/strong>\u00a0(protection from burn-out, alcoholism, etc.).<\/p>\n <\/div>\r\n<\/div>\r\n\n\n

\r\n

In the event of non-compliance, labor inspection authorities can file a report, refer the case to a judge for urgent action, and even request the temporary shutdown of operations. The company may be fined an amount of at least \u20ac3,750 and its executives can be sentenced to prison.
\nTo comply with\u00a0legal requirements<\/strong>, the company must prove that it has carried out a risk assessment and implemented preventive initiatives.<\/p>\n<\/div>\r\n\n\n

Step 1: assessing risks<\/h1>\n <\/div>\n\n\n
\r\n

To the extent that they are relevant to its business, the company must assess risks related to :<\/p>\n

    \n
  • manufacturing processes,<\/li>\n
  • work equipment,<\/li>\n
  • chemical substances or preparations used,<\/li>\n
  • workplace installations,<\/li>\n
  • workstation design.<\/li>\n<\/ul>\n

    The results of this assessment must be presented on a single document (Document Unique d\u2019\u00c9valuation des Risques Professionnels or DUERP<\/strong>), along with an inventory and ranking of occupational risks and proposed prevention initiatives.\u00a0All organizations<\/strong>\u00a0(including services sector companies)\u00a0must have a DUERP and update it yearly<\/strong>. The company\u2019s employees, employee representatives and labor inspectors must all have access to the document.<\/p>\n<\/div>\r\n\n\n\n

    Step 2: implementing initiatives<\/h1>\n <\/div>\n\n\n
    \r\n

    Based on the risk assessment presented in the DUERP, employers must take corrective measures as well as steps to prevent risk<\/strong>, such as providing training or reorganizing production methods.
